Yes, the Small Estate Affidavit should work. It may depend on the bank. When I handled a matter that included Bank of America, they required the Small Estate Affidavit form that they produced rather than the normal form. To be honest, the two were almost exactly the same;  just one was on the B of A letterhead.


The one thing I would definitely recommend is include that safe deposit box in the list of assets that are covered by the Small Estate Affidavit.


Once I produced the Small Estate Affidavit and the Death Certificate to the manager, and they jump through whatever hoops they have to jump through, i was able to access the safe deposit box of the decedent.
