Dave,

Most (but not all) insurance policies have a 1 year “suit of limitations” clause in the policy itself that limits your client’s timeframe for a potential breach of contract cause of action. Outside of that, both the tort of bad faith and violations of the Insurance Fair Conduct Act (RCW 48.30.015) generally have a 3 year SOL.

Hi, Listmates.
I’m helping a client make a claim under an insurance policy—their business was damaged by a neighboring business springing a leak and flooding into their store.
What if any statutes of limitation or administrative rules in WA affect the time in which a claim can be made under an insurance policy in WA? I don’t think we have a problem because the events happened within the last year, but I’d like to make sure.
