I’ve always distinguished between known and unknown by checking the mail for known and by publishing the probate notice to creditors for three consecutive weeks for unknown creditors to come forward.  Four months after that first publication, there is no obligation to pay a creditor who comes forward after that. I had a case once where a hospital presented a bill past the four month period and I wrote to them that the time to present creditor claims had passed. I never heard back. I think it was for around  $30,000.

I have heard varying thoughts on this.  I actually heard one presentation where they claimed they thought as an attorney sending notice to people you just think may be creditors you open yourself up to claims by the PR because they are not known.

I personally only ask about known creditors otherwise I think it’s a slipper slope – do you open a wallet and give direct notice to ever credit card because it may have been used?   I don’t, we check the mail and do our best.

I am curious what other’s have to say and certainly acknowledge one size does not fit all.

Listmates,
Medical bills sometimes arrive many months after the death of a decedent.  When representing a PR, is it a good practice to mail a Probate Notice to Creditors directly to the decedent’s medical providers (or at least as many as can be discovered by the PR) to cut off their claims against the estate?
