I agree with Eric's response re Option 2. You could also ask all interested parties to sign a document stating that they agree to daughter's appointment with NP powers. I've been quite successful in obtaining those over the years.

I agree that Option 2 does not work-Dad is disqualified under RCW 11.36.010(1) as "person of unsound mind" as the statute puts it. Even if Dad could serve, his core duties as PR are not delegable to D1 as his Conservator. It's perhaps a problem of redundancy: if Dad can't perform any of his duties without D1's help, why not appoint D1 directly? Just the fact that D1 would have to petition on Dad's behalf would be enough to demonstrate that Dad can't really serve as PR.
I am guessing this is about whether or not notice of petition for NPs is required? I don't think there is a way around it. You could get D1 appointed without NPs first, just to get her in place and she would have power to gather assets and take control of the administration. Then petition for NPs separately with notice as required.

I appreciate your advice on this matter.
Facts: Mother passed away, no Will, Dad is incapacitated. Court appointed one of their Daughters (D1) as Dad's Guardian and Conservator.
D1 intends to petition the court to be the PR of her Mother's estate and seek nonintervention power. She can petition in her name (Option 1). My question is whether she can petition in her capacity as Guardian and Conservator of her Dad (Option 2)? Option 2 makes the surviving spouse as the petitioner.
Since petitioner needs to sign an Oath, I think Option 2 does not work as Dad can't give Oath. Am I missing anything? Any comments are greatly appreciated.
