Hi Ann,

Technically, nothing has to be transferred into an RLT (and it’s sadly often what I see) but if you want to avoid it transferring under a pour over will you should either 1.  Transfer it to the RLT, or, in your Pour Over Will have a specific bequest as to where the vehicle goes – which then creates a possible probate, or add jwros to title where allowed.

Regarding Mobile homes, they are deemed tangible personal property or real property depending on how they are registered.  I personally find they can create quite the headache if proper planning isn’t done.  It is essential for you to find out if the Mobile home is deemed affixed to the land (and thus real property) or separate (and thus personal property).  I always start with information at the assessor’s office if my client doesn’t have it handy.
