Lovie -

            We are frequently asked to serve as PR in these circumstances too.  100% agree with Bruce's comments below.  You may wish to require as a condition of your serving that you are permitted to retain probate counsel (even though you are probate counsel) to make sure you have an outside objective view on how to proceed.  I wouldn't pass up an opportunity to pick Bruce's brain on this. I imagine he has a ton of experience with these sorts of cases.

Hi Lovie,

I have been recruited to serve as a PR in that circumstance many times.  You definitely need to be aware of the typical view of the PI lawyer of a probate and a probate administrator's view. Wide cultural differences between PI lawyers and probate lawyers. Potential administrative malpractice issues that are not on the radar of a PI lawyer.

I have been asked to open a probate for the sole purpose of allowing the PR to bring a wrongful death suit. There are no assets and no known debts.
