We usually do a Motion and Order in these situations because the Clerk will often want to collect another filing fee if the pleading is entitled a “Petition”.

If you have ever had occasion to file a (petition?) to reopen probate and issue letters to the previously appointed PR, would you be willing to share a model with my colleague and I offline? (She is in the cc. line.)

Two related real property parcels were transferred with ineffective deeds by two PRs in related cases in the same Washington county nearly 20 years ago. Both PRs are alive and cooperative, as are all the related parties. RCW 11.76.247 and .250 seem to provide the same superior court ample authority to request issuance of new letters testamentary. I think we could “make up” the petition, honestly, but maybe we’d miss something others have thought of!
