[WSBAPT] probate unknown assets

If it is an estate involved in, have gotten to know the players, and no conflicts I have allowed checks to run through an account internally and send firm checks to beneficiaries. Also on a few occasions, the bank has known their client well enough to run the checks through their personal account. Neither is ideal but can you justify legal fees to reopen for small amounts?

This problem arises and most banks won’t accept checks made payable to a decedent or estate without PR authority so you find yourself having to reopen the estate. This is why you need to be sure before you close. Wait out a few months, do some pre-distributions, and then close. There is no way to “hold back” authority for checks or to leave the bank account open that I know of; only to deal with taxes. I realize the bank may not know you have closed the estate unless the PR closes the bank account and provide the PR with an opportunity beyond the closing date but that would be a risk to the PR and you. I wouldn’t recommend that.

Subject: [WSBAPT] probate unknown assets

Hi Listmates,

In a probate where a few surprise checks have popped up, how do you all usually handle closing up the probate in a way that accounts for the possibility of more surprise checks coming through after completion?

Any go-to language you like to include in the declaration of completion? Would it still be possible to close w/ receipts?

Thank you,

Harkiran
