I’m not so sure that all garnishments are stayed. Take a look at Proclamation 20-49.14<https://www.governor.wa.gov/sites/default/files/proclamations/proc_20-49.14.pdf>, I believe it is the latest iteration of the garnishment stay. In the FURTHERMORE section, the governor appears to acknowledge that the stay has “not been applicable to garnishments for continuing liens on earning since May 27, 2020.” The limitation is on bank accounts, but that is only up to the stimulus amount.

I would talk to Matt Green or Elizabeth Norwood. I refer my judgments to them for collection, and they have obtained favorable results for us, even during the pandemic. They are frequent presenters at Collection CLE’s and know this area quite well. Right now, all garnishments are stayed.  I have a client who has been waiting over a year to garnish from a PR who stole $55k from an estate.

If the order to pay a sum certain was actually entered as a judgment against the boyfriend, if he has a job and if he receives a paycheck, your friend can have a lawyer bring a garnishment action against his wages.  OR, if your client knows where his bank accounts are, they can garnish his bank account.

For lawyers that regularly handle garnishments, this is very straightforward.

I do not believe “contempt of court” is the appropriate action when a debt is outstanding.

In the family law arena, there is long standing, well-settled law that contempt for failure to pay money is only proper if the payment is related to support. So, if an EX owes $100K for a property distribution, contempt isn’t possible.  If you have a judgment against an Ex, you have to find their assets and garnish or get a writ of execution.  So, I assume this would be the same in other civil areas of law.

She needs a Pierce County attorney to help her get payment on the judgment, motion for contempt in Superior Court, etc.  Does anyone have a recommendation for a Pierce Count attorney who can help her collect on the judgment?
