[WSBAPT] Common Disaster Clause and Life Insurance

Can a GAL execute a disclaimer on behalf of minors? I suspect not, so we may need to utilize TEDRA, probably not NJBA, but a petition and order.

Heather,
I do not believe that will be the likely case BECAUSE:
The "Super Will" statute 11.11.020 defines non-probate assets pursuant to RCW 11.02.005(10). Life insurance is specifically exempted from the definition of a non-probate asset.

Can you get it back into the estates by utilizing disclaimers? NJBA?

Dealing with deaths from a common accident, the following clause is in a "RocketLawyer.com" Will. If each spouse is the primary beneficiary of policies on the other's life, is there any likelihood that an insurance company will pay proceeds to spouse's estate rather than contingent or default beneficiaries? Presume this is the scenario we want. Contingent or default beneficiaries is not a good solution and the hope is that the insurance money can equalize the estate values for WA estate tax purposes, to ensure both estates benefit from the full exclusion amount.
