[WSBAPT] Death Certificate Submission via Ex Parte (King County)

For what it is worth, I similarly file a declaration that I have a certified death certificate of the decedent in my possession.  So far, in the 5 or so years that I have been including the declarations with the probate documents, I have not had a probate kicked back for lack of a death certificate.

I think this is a Judge Shaffer-specific issue. Since e-submissions began I’ve never had a probate bounce on this issue, until last week, by Judge Shaffer. In lieu of a death certificate I filed my own Declaration stating:

I have reviewed a certified copy of the death certificate of [Decedent] and hereby confirm that [s/he] died intestate on [date], in [county] County, Washington. For reasons of privacy, I am not filing a copy of the decedent’s death certificate with the court.

That sufficed and Judge Shaffer entered the Order on re-submission.

I have opened 12 probates in King County since June using the Ex Parte via the Clerk website for King County.  Each time I have done it the exact same way....never with a Death Certificate.

This past Friday was the FIRST TIME - I had my submission rejected because I did not upload a Death Certificate. Maybe I have lucked out - maybe Judge Shaffer has never had my materials before - I don't know - but I wanted to just put myself out there as a warning to others. Upload a death certificate and just unclick the "E-File Me" button to avoid wasting $30.

Here I am - serving as a warning to others :)
