[WSBAPT] Successor Trust Language

I am thinking about a trust where the beneficiary has the power to appoint a successor trustee other than herself. There’s no other limitation other than the trust does say the beneficiary shall have no power or authority over any trust assets. The particular question I have in mind is whether the beneficiary can appoint her spouse. For what I am thinking about, I’m leaving aside the tax implications of the transaction and I am only mildly considering the creditor implications. I am really just focusing on the appointment language and whether that gives an opening to appointing the spouse.

All thoughts, as always, will be appreciated.

Sincerely,

Jacob
