If truly no medical bills or wage loss I think you are correct.  It would be unusual for such a settlement not to include some losses that are cp.

Subject: [WSBAPT] injury settlement separate property

Listmates, Decedent has a credit shelter trust Will requiring ½ community property and 100% of separate property up to exemption for federal estate tax goes into the trust. Surviving spouse keeps the other ½ CP and her separate property in her own trust. After death, decedent is receiving significant settlement monies from an injury suit pending at the time of death. All monies relate to injuries, nothing for anything like lost wages. This is separate property that must be 100% allocated to credit shelter, correct?
