So bank account was non-probate asset, and its DOD balance was diminished by paying post-death estate HOA expenses? It’s kind of a dumb mistake by the bank, and it’s aggravating, but I don’t think there is a worthwhile claim.

Sounds like easiest fix is to figure out how much the account was improperly used for estate HOA expenses and pay that to the beneficiary from estate funds. I don’t see a claim against the bank because I don’t see any injured party, if the estate simply reimburses the account beneficiary for the amount used for estate expenses.

Just got a message from an Executor with the most bizarre story.

Decedent passed in July. He left behind a bank account at Chase Bank with a beneficiary designation.  Executor is appointed, visits the Chase branch, they take death certificate and freeze account and advise that they will send funds to the designated beneficiary.

Seven months has gone by and it was discovered that Chase Bank did NOT send the funds to the named beneficiary. Instead, they un-froze the account and auto-payments for the HOA monthly dues resumed (unknown to the Executor who was using Estate funds to pay the HOA....they got a nice note about getting that overpayment returned, too).

Has anyone ever experienced this before? Worth pursuing any claim? (i'm guessing not).

Just very strange.
