Definitions and use of terms. (Effective until January 1, 2022.)
When used in this title, unless otherwise required from the context:
(8) "Issue" means all the lineal descendants of an individual. An adopted individual is a lineal descendant of each of his or her adoptive parents and of all individuals with regard to which each adoptive parent is a lineal descendant. A child conceived prior to the death of a parent but born after the death of the deceased parent is considered to be the surviving issue of the deceased parent for purposes of this title.

I have a new client who is the mother of a deceased son, 22 years old.
His girlfriend was pregnant at the time of his death.
Anyone ever argue that once born, the newborn child is entitled to wrongful death proceeds?
Statute seems to imply child or children, does not indicate born or unborn.
If allowed, then it seems the child would be entitled to 100% of the WD proceeds and the parents/siblings would not be entitled to anything.

Wrongful death-Right of action.

If there is no spouse, state registered domestic partner, or such child or children, such action may be maintained for the benefit of the parents or siblings of the deceased.  In every such action the trier of fact may give such damages as, under all circumstances of the case, may to them seem just.
