Good morning,

Decedent had a 2014 car for which he had a car loan through a local credit union.

Credit Union has filed a creditor claim for the outstanding amount of the loan, including interest, probably late fees, etc., in the amount of $23,000

Vehicle has 100k+ miles on it and is worth about $10k less than the outstanding loan balance.

Is there any statutory language or wording to look for in the loan documents or otherwise to get the credit union to take the car back as their collateral and waive the difference?

Thanks in advance -
