Dalynne has all good suggestions. In addition, if it doesn’t stop it, tell the PR to keep track of their time in responding to the PIA heir and let them know that all time charges for PR and PR’s attorney to deal with PIA’s incessant inquiries will be charged ONLY against their distributive share. I don’t know if that would hold up in court, but it may quell the behavior.

Here are some things I have done in the past:

  1.  Make sure to tell the heir that they should seek independent legal counsel for assistance as you represent the PR of the Estate.
  2.  Allow a pre-distribution of some monies while protecting the assets and creditors.  This sometimes assists the heir with a little money.  Make sure they sign a receipt.
  3.  Give the heir a deadline – whether 3-6 months that the situation should be handled, what is left to do and that you will provide closing documents at that time.
  4.  Stop taking their calls and ask that any further communication be in writing.

There are times when nothing works and you have to just carry on and do what needs to be done.

I have a probate matter where the estate will be split 50/50....there are complexities regarding a single asset that I we are working toward resolving. The estate is barely 4 months old but the one simply has a personal financial need and continues to harass the Executor to just complete everything now.

I tried the method of writing and politely explaining that we are working through the process and will wrap as soon as we are able, but he is not responsive to such correspondence.

Suggestions?
