If by new, you mean it wasn't required 10 years ago, it is a new policy, but it has been technically required, or some equivalent, like the affidavits I use, for several years now.

Good information, thanks all.  I am about to deal with a probate for a decedent who died in Colombia (but resided in King County), and apparently it?s going to be very difficult to get the death certificate.

For what it is worth, I similarly file a declaration that I have a certified death certificate of the decedent in my possession.  So far, in the 5 or so years that I have been including the declarations with the probate documents, I have not had a probate kicked back for lack of a death certificate.

I think this is a Judge Shaffer-specific issue. Since e-submissions began I?ve never had a probate bounce on this issue, until last week, by Judge Shaffer. In lieu of a death certificate I filed my own Declaration stating:

I have reviewed a certified copy of the death certificate of [Decedent] and hereby confirm that [s/he] died intestate on [date], in [county] County, Washington. For reasons of privacy, I am not filing a copy of the decedent?s death certificate with the court.

That sufficed and Judge Shaffer entered the Order on re-submission.

I have opened 12 probates in King County since June using the Ex Parte via the Clerk website for King County.  Each time I have done it the exact same way....never with a Death Certificate.

This past Friday was the FIRST TIME - I had my submission rejected because I did not upload a Death Certificate. Maybe I have lucked out - maybe Judge Shaffer has never had my materials before - I don't know - but I wanted to just put myself out there as a warning to others. Upload a death certificate and just unclick the "E-File Me" button to avoid wasting $30.

Here I am - serving as a warning to others :)

I submit an affidavit similar to what Eric references in lieu of the death certificate as a matter of course. Haven?t had one bounce yet. The ability to submit via ex-parte and not file is also a good solution.

Pre-Covid, I frequently had judges/commissioners in Seattle (King County) request to see the death cert, so I have always included it in my online filing.  You know....the 'better safe than sorry' route!

I am going out on a limb here and really curious if anyone else has thoughts (or maybe you?ve found you answer and I missed it).  Clearly if they are titled in  decedent?s name they are part of the estate and the Administrator has the obligation to ?gather all the assets and distribute them in accordance with the laws of intestacy?.  With that in mind, I would say she has no obligation ? however with them being on her property, I think there could be a host of Public Nuisance issues that may expose her to liability ? I?m having flashbacks to my law school days.  Then, as to the question of her rights in having them removed, I get flashbacks of all the bailment rules. I would assume she is considered a bailor but what category post death I?m not sure.

If the son is the sole heir, my off the cuff thought is that her best bet is to get an e-mail from PR indicating she can have them hauled off and maybe she even pays ? not sure how much it would be ? she got the home in an intestacy estate which is pretty impressive (jwros? todd?).  If he is not the only heir, she absolutely needs to rethink a strategy because the last thing she needs is a sibling to say they should have gotten 2 certain cars or the boat or whatever.

Another situation of bad facts, creating work that costs money and eventually someone has to pay but as an initial answer, the PR should be work on it.  I know this isn?t super helpful but I didn?t see anything come by and these are the real life probate type issues I find fascinating.

Son of decedent/Administrator of an intestate estate is asking girlfriend of decedent (PC) to retitle scrap boat, trailer, cars into her name and pay to have them removed from girlfriend's lot (decedent's home has been retitled into girlfriend's name). She can refuse, right? Does she have any liability for these? What are her legal rights in terms of getting these off the property? What if they are impounded? Any legal authority for this?

These are the last assets to be dealt with before probate is closed.

An out-of-state PR client is looking for recommendations for some help dealing with inventorying, sorting, packing, etc. the decedent's large home (not a hoarding situation, just decades of stuff in large home). Not looking for liquidation sale.

Hello all,

Forgive me if I have asked this before but I have to find a Divorce Decree for a decedent to confirm the real property decedent owned until her death was in fact hers through a property settlement.  Is there a way to search by multiple counties as once.  The family cannot find the divorce records and don't know what county the divorce was in.  We didn't have luck finding it in the county that everyone thought the divorce  happened in.  We will call county by county if need be but I was hoping we may hear of a better way.

Greetings List -

I have my first probate with family owned property.  Originally it was owned by parents, then when last parent passed, equally to the four children.  Now the first child has passed, and his Will sends it equally to his three siblings.  There is nothing special - no trust, no minors.  I just want to confirm given how difficult it is to record things these days:

1) Deed of PR - same as always but instead of to the name of one person, to the three siblings. Correct?

2) REETA - Box 1 - same as always, the Estate as represented by the PR; box
2 - each of the siblings names to just mirror the Deed of PR? Would I add a separate paper since they all live at different addresses or would it be a fractional share that I file three separate REETAs?

I am certain that I am overthinking this but having heard the horror stories from various colleagues about the pain it is to have family owned properties like this - I wanted to check first.

That still doesn't go back to records more than about 40 years old, so if this was a long time ago, you might pay a title insurance company to search for it in their database; they will be able to search for everything affecting title to the specific property.

Hello all,

Forgive me if I have asked this before but I have to find a Divorce Decree for a decedent to confirm the real property decedent owned until her death was in fact hers through a property settlement.  Is there a way to search by multiple counties as once.  The family cannot find the divorce records and don't know what county the divorce was in.  We didn't have luck finding it in the county that everyone thought the divorce  happened in.  We will call county by county if need be but I was hoping we may hear of a better way.

You should be able to check on the Washington Courts website by doing a name search for the parties. You now also have to search on Odyssey.
