Is the medical coverage based on the mother’s employment or through Apple Health?

I’m wondering if the mother is correct that medical coverage will terminate on the 18th birthday.  If it’s through her employer, some COBRA option should be available.  If it’s through the state, I would think proof of filing the guardianship should be enough for a short period of time.

Check with the medical insurance provider—will proof of filing the guardianship be sufficient for a short period of time?

Also, is there some authority that could be granted to the GAL that would be helpful?

I would get mom on the phone with me and the medical insurance provider or the caseworker to sort this out.

I have a client who waited till the absolute last minute to tell me she needed to be appointed guardian of her severely disabled daughter turning 18 in early November.  She needs to be appointed on the date of her daughter’s birthday so her daughter’s medical needs can be continuously covered.  I have filed many guardianships, but nothing that required immediate appointment on at least a temporary basis while waiting for the regular appointment.

I have all of the basic documents ready to file, but can’t find any statutory or case law for emergency appointment in the State of WA.  I was planning to file a motion for order shortening time and a motion for temporary emergency appointment, with the hearing to be set for the day of the daughter’s birthday.  Unfortunately, I can’t get all of the notice parties (besides the daughter herself) to waive notice, because the daughter’s father is the petitioner’s estranged ex-husband.  Any thoughts/suggestions?
