Long-time client called this morning with request from his son-in-law
for
referral to attorney in Silverdale that could make a house call on
son-in-law?s mother for estate planning update. Mom has advanced
cancer and
is now bed ridden. Very tragic and sudden discovery, within one month
of Mom
losing her husband. Mom needs updated powers of attorney and wants to
update
a revocable trust. Assets in range of one million dollars so no
apparent
need for tax planning. Mom contacted attorney in her area, but
attorney is
not responding (two weeks).
Please reply off list if you are able to do a house call on short
notice. I
will pass on all names to PC.

estate. She is nearing the end of probate and discovered her father's

Which documents need to be filed to get the will probated and keep

as PR without holding up the process? The distributions are the same

her and 2 siblings). I can't find the RCW or mechanics of doing this

I would start with a regular petition to prove will and appoint
executor as if no probate had been opened, and then add information to
confirm that the estate is already open and administrator appointed,
and the administrator is the named executor, and request that the
Letters of Administration be cancelled and Letters Testamentary issued
in their place, and that non-intervention powers be confirmed.
By statute there is no notice requirement to anyone (other than
surviving spouse if any) for proving a will and granting NPs under a
will, so I don't think it will hold up the estate much at all. Could
be submitted ex parte.

I recently had this happen. Review RCW 11.28.150.
You file the amended petition in the same cause with the Will. The
court revokes the letters of administration and issues letters
testamentary.
RCW 11.28.150
Revocation of letters by discovery of will.
If after letters of administration are granted a will of the deceased
be found and probate thereof be granted, the letters shall be revoked
and letters testamentary or of administration with the will annexed,
shall be granted.
