[WSBAPT] Surviving Spouse Community Property claim on IRA benefit

Client's husband died, owning an IRA account. Husband accumulated the funds
in the IRA before the marriage/CIR with his spouse. Husband had named his
brother as beneficiary of IRA.
Client and spouse marry after IRA established. Parties executed a broad
Community Property Agreement that converted all separate property to
Community and directed that all separate property pass to surviving spouse.
Husband overlooked changing beneficiary designation on the IRA before his
death. Account passed to Husband's brother by beneficiary designation. Wife
now wishes to assert claim against the brother, based on Community Property
Agreement.
 
Need a referral to attorney to advise wife on this issue.
