Quick question. Are there any descendants or minor children? 

 

Here is a simplified answer. Generally no descendants it passes to surviving
spouse 100%. If it was "Homestead" and the estate assets outside of the
homestead is less than $75,000, a summary administration is opened and a
petition to determine Homestead is filed in the case. The petition is filed
order to notify the Florida Medicaid TPL recovery program and any known
creditor an opportunity to challenge the Petition. If the court grants the
petition, it passes free of the Medicaid lien and creditors' claims.

 

Not a quick process, but generally not lengthy.  No such thing as
Non-Probate Affidavit.
