Jenny,

In my 15 years I have done mutual wills/contract to will only 2 times because my client’s on the one hand, didn’t want the complexity of a trust after the death of the first to die and trusted their partner, but not so much trust as to leave outright apparently.  Of course I don’t know your facts.

I am not sure that I would do that again – the reality is, what good are mutual wills if survivor goes rogue?  Where is the potential recourse?  If it is blended family I suggest giving something to the branch side that looses the first parent right then and there – hope the mutual Wills plan is carried out but if it isn’t the kids something – does that make sense?
