I have –

The key issues is to understand that the agreement needs to be “real” otherwise creditor’s can pierce.  I recommend each party have their own representation otherwise it could be argued one party strong-armed the other party.

There are a host of issue, divorce down the road, outright vs. lifetime martial trust or lifetime non-marital trust, are there current claims outstanding (assuming no – so that’s the time to plan), continued use of MD spouse without charge, etc. etc.

Has anyone dealt with this situation? Married estate planning couple clients, and she is a physician. Although she has medical malpractice coverage through her employer, she is still concerned about exposure of the marital assets in the event of a lawsuit naming both her employer and herself. We have talked about creating a property status agreement declaring some assets to be her husband’s separate property as a protective measure.
