[WSBAPT] Certification of a Complaint v. Declaration of Witness

If the complaint has the "I declare under penalty of perjury" language and
so is a declaration under RCW 9A.72.085, then I would say that the complaint
can be used in a summary judgment motion.  However, I would avoid relying on
it and would state the facts in a separate declaration.  I would rely on the
complaint only if it should happen that I cannot file a separate, timely
declaration.

 

If this does not answer your question, I'm not sure what it is.

This is an off topic question.  Is a client's certification of a Complaint
the same thing as a Client's Declaration, filed in support of summary
judgment, setting forth the same facts in the Complaint?
