Subject: [WSBAPT] Delegating Power of Attorney

Good Afternoon List -

Potential client is the now adult son of a woman with a mental disease/defect that has rendered her unable to make her own legal decisions and lacking capacity to execute new documents.

Existing POA allows, expressly, for the attorney-in-fact to delegate his power to another under a second called "Substitution and Revocation" - so we have authority based upon 11.125.140 to delegate.

The attorney-in-fact has agreed to allow Son to step in and serve in this capacity. Son has agreed to step into the role.

Is there a specific template for this situation? Do we need a limited Power of Attorney from the initial agent to the new?

Thank you!
