Be aware that the IRS may require the Non-resident PR to file a W-7 and
obtain a TIN, so the NRPR can turn around and get a TIN for the Estate.

The EIN will most likely have to be obtained by fax, not online.  Type on
line 7b: Nonresident Alien - No SSN.

Dalynne,

 

I don't think there are any prohibitions, but I have run into issues dealing
with PRs who are not US persons. US citizens living abroad probably don't
have any problem, but if they don't already have a US Tax ID number, it will
be extra challenging getting an EIN for the estate.

Can a nonresident of the US be an Administrator while an attorney serves as
resident agent in an estate in Washington?

 

I reviewed RCW 11.36.010(6) and do not find a definition of nonresident in
Title 11.  The proposed Administrator is otherwise qualified.

 

(6) A nonresident may be appointed to act as personal representative if the
nonresident appoints an agent who is a resident of the county where such
estate is being probated or who is an attorney of record of the estate, upon
whom service of all papers may be made; such appointment to be made in
writing and filed by the clerk with other papers of such estate; and, unless
bond has been waived as provided by RCW

nonresident personal representative must file a bond to be approved by the
court.
