Diane, thank you for your reply.  There is no beneficiary designated, unfortunately.  It was hoped that by using the pour over Will, the Trustee of the LT would be able to claim to be a successor using an SEA.

My first question, since it is retirement benefits is can you confirm that there is no beneficiary designation on hand.  If there is not, and the estate is default or contract, I will tell you that you will save time and emotional energy by opening the probate.

I had a case with a financial institution whom I always have issues with who requested letters even when there was a beneficiary designation but due to some circumstances that existed the institution would not budge.  I decided it would cost me more to get a court order for them to follow the laws then just to open the probate.  My account dollars were in fact more significant so it didn't seem worth fighting and seeking legal fees.

Listmates -

Decedent has two retirement death benefits with Boeing, totaling about $6,500.  Decedent had a living trust and a pour over Will.  The trustee attempted to use a Small Estate Affidavit to obtain control of the death benefit.

Boeing Retirement Service Center has rejected the claim, stating that "the benefit can only be paid to an Estate."

Has anyone run into this issue?  The client is, of course, reluctant to open a probate for such a modest sum.
