Dear Jenny:
Generally speaking the courts in Washington would “favor” a parent over a stranger. I am assuming in this response that father retained his parental rights in Canada. Washington courts, through the authority of comity would recognize the parentage and would not deny a parent their rights in raising the child.

Hi All,

I have a client who married and divorced in Canada, and we are naming guardians for her child as part of her estate planning. She does not want the child to go to the ex spouse who currently resides in Canada, should she die. Would our courts follow her Will, or would dad in Canada have priority regardless of her nomination?
