Dear Bryan:
While it seems Rathbone, recently decided by the Supremes, would indicate your client, with nonintervention powers, does have this authority to designate the local friend to conduct this sale, I have to wonder why, in this day and age of scanned documents, faxed documents and such that what he needs is somebody to keep him advised but for him to make the decisions. He could provide that limited power of attorney but to what end. He will still be responsible. Better to not delegate and have the friend gather insight for him and send that along so the best and timeliest of decisions can be made. I also think Paul Neumiller's perspective is correct. Check with the title company so see what they require. Nonresidents in probate settings do designate resident agents for various purposes here. So it can be done. I am a control oriented person, so my advice is no doubt emanating from that point of view.

Greetings All,

PR was recently appointed to administer her sister's estate. PR lives out of state and wants to appoint a local friend to facilitate the sale of estate real property (i.e., execute a limited power of attorney).

This is the first time I've come across this situation with a PR, and I'm having trouble finding any authority for or against it. Any and all guidance would be greatly appreciated.
