[WSBAPT] DSHS Claim Against Estate

It is a little more complicated than you might think.  I recently had a wrongful death settlement paid to an Estate and DSHS filed a lien along with Medicare claiming repayment for medical bills paid.  I've attached some information I found but I recommend you call DSHS and discuss the lien and any monies in the estate.  I was able to reduce a lien from $214,000 to $30,000 but it took several letters and discussions.  I recommend you face this head on and address it directly with DSHS.  I wouldn't want to see estate distribution without addressing the lien.

Was DSHS timely provided with direct notice to creditors and the decedent's social security number as required by RCW 11.40.010, 11.42.020 and 11.62.010? If so, I think they are effectively barred, as any other creditor.

Dear Colleagues,

I'm sure there's a simple answer to this question, but I have yet to find it:

Is DSHS exempt from having to present a claim against an estate within the creditor claim period when seeking recovery for state medical assistance? In this case, the claim period expired on July 14, 2018. The DSHS claim was not submitted until July 17, 2018.
