[WSBAPT] Vulnerable Adult Temp. Protection Order Issue

Hello,

This is not my area of law and the client doesn't have funds to hire an
attorney, however, they're awesome people in a bad situation and I would
love to get some advice that I can pass on to them to help them out.

The clients are my old clients (mother and adult daughter). They had to get
a restraining order against someone. They saw the court advocates who
automatically assumed the daughter who is developmentally delayed, needs
assistance and mom should have guardianship so they instructed mom to get a
regular TRO and apply for a temp RO/ vulnerable adult for daughter and gave
her the corresponding paperwork so she did, however, was chewed out by the
commissioner that she must have guardianship and implied she might want to
look into that before the hearing in two weeks to extend the TRO for a
year. Commissioner granted the TROs for both.

The daughter does not need guardianship, she is fully functional, has held
a job for years, is learning to drive, her doctor had previously signed a
note stating she has the capacity to understand legal documents and sign
them (done last year for a different matter). The whole goal here is to get
daughter independent, guardianship would not really help that.

My question is, can they amend their petition or clarify at the next
hearing in two weeks that they just want a regular protection order for
daughter as well? If so, would taking the doctor note from last year
suffice? Or do they need to apply for a new TRO for daughter? What's the
best way to remedy the situation and avoid the guardianship talk?

Thanks so much,

Setareh
