Instead of joint probate start one forDad then have that PR execute an affidavit reciting moms death describe property state it was community all debts were paid or provided for attach certified copy of death certificate and title co will accept that then  quit claim deed it to son with all encompassing title language have done this many times without a problem

The language in the pleadings can get a little unusual, as you need to open one as testate, and one as intestate, and then get Letters Testamentary, and also Letters of Administration.  (unless anyone else has a workaround for that, which I would be happy to hear!)
