It's fine, so long as done by duly authorized person in the local jurisdiction. See RCW 42.44.130 - .150<http://app.leg.wa.gov/RCW/default.aspx?cite=42.44&full=true#42.44.130>.

Sincerely,

Eric

Jenny,

I have had clients use an out of state notary before for powers of attorney. The point is for someone qualified to confirm they are who they say they are, so I can’t see why it would be a problem. I’ll be interested to see if anyone disagrees.

All,
I have a client who is a resident here for whom I've prepared will, POA, HCD. He is out of state and would like to sign his docs as soon as possible. I didn't see anywhere in the statute that required a WA notary, but wanted to double check to make sure that having an out of state notary would not be problematic.

Thank you!
