[WSBAPT] Death certificate required in King County?

There are unwritten rules of baseball, and there are unwritten rules that emanate from each of the 39 courthouses in this state, in many different areas of the law.

As to probate in Clark County, we have no Death Certificate requirement.  We have the sworn statement of the Petitioner as to the status of the Petitioner, as to the facts involving the death of the Decedent, a general idea of the property owned by the Decedent, and details regarding the will when the probate is of a testate Estate, and that is all that is required to get Letters of Administration or Letters Testamentary issued.

In King County, it is apparent that the Commissioner might well refuse to enter an order opening a probate if there is no Death Certificate presented, and one could liken that to a baseball pitcher purposefully striking the batter with a pitch when that batter does not follow the unwritten rules of how baseball players are to conduct themselves.  In the end analysis, it is easier to abide by the unwritten rules, and one gets hurt that much less, if one does so (assuming one has knowledge of the unwritten rules).

It is sunny out today, at least in this part of the state, and my mind has wandered to thoughts of the upcoming baseball season.

Where there is a delay on issuance of death certificate, in other counties I've used a copy of an obituary to substantiate death (none of which is required, as I understand it, under the probate code-just another one of those unwritten rules out there). Good luck, Cy

Somewhat off your particular question but in Snohomish County they will always ask for a death certificate and often, if the decedent was married but widowed, they will ask for some form of proof that the spouse is deceased and not one with preference to serve as PR.  The level of proof for the latter is usually far lower than that required for the decedent.  We often just redact the few bits of sensitive information or file the death certificate under seal.  GGG
