Bryce, This is always the problem - changes in beneficial and note ownership
outside the record. Sometimes they are like this case where WAMU failed and
was acquired by JPMorgan Chase "without government assistance". But each set
of facts is unique and needs investigating. For example, there are assets
from WAMU that actually wound up elsewhere, either directly or indirectly.
There may be a for sale sign on the property, and you can call the agent.
Look for notices of default and notices of trustee sales. The County will
tell you who is paying the property taxes, and you can follow that lead. We
wind up serving every lender who appears to potentially have an interest.
And filing a declaration about how we tried to figure this all out, or even
put that in the complaint when discussing each defendant. 

 

WAMU is the last holder of the interests according to the record; it has no
registered agent but does have a c/o name in the corporations website. I
would at least attempt to contact her. 

 

If your deed of trust is really outlawed, then you are probably ok, but that
is not as simple a proposition as it sounds sometimes, as well. But here,
when WAMU was owed the debt, and its assets were transferred somewhere, the
likelihood is that the debt was paid and the connection from the servicer to
the note holder was not good enough to result in a reconveyance.

I need to start an action to clear a deed of trust in favor of Wa Mu since
the underlying debt is barred by S/L Title still shows Wa Mu as owner of D/T
The question who do I serve since I believe Chase acquired the assets of Wa
Mu but this one has not been transferred. Does anyone have any thoughts on
service? Do I serve Chase as the successor in interest to Wa Mu.? Thanks
