I've done exactly that with a Florida guardianship with property in Washington. It worked beautifully - however, I had to spoon feed the title company, but ultimately they were happy. Eileen

Wouldn't registering the Virginia guardianship under RCW 11.90 work?

Call back the title company and find out that if the Virginia court authorized the guardian to sell it and execute all documents in connection with the sale, if that would work. I have done this in the reverse situation, gship in WA, and real estate in California, and completed the sale without issue.

As an aside, with our interconnectedness and the ability to access court records, etc., that the concept of ancillary probates and ancillary guardianships (like the situation you have) will be a thing of the past in the not so distant future. I could understand the reason behind have a the local court issue such orders, etc., but not sure it is necessary nowadays.

Subject: [WSBAPT] Guardianship question

I have a client whose mother is a resident of Virginia but owns real estate in Washington. Mom has been deem incompetent and client was appointed Guardian and Conservator under a guardianship proceeding in Virginia. Client/Guardian is now trying to sell mom's WA property and the title company is telling her that she has to move the guardianship to WA Courts and get permission from the WA court to sell the property. This is the only item they have in WA and don't really want to transfer the guardianship to WA only to sell the property and then have to transfer the guardianship back. Is there a more efficient way to do this that I'm missing?
