Julie: it is very unlikely that a single asset 'separate property' agreement would be enforceable if the agreement mentions only that asset.  Post nuptial agreements are suspect anyway.  And the court faced with a divorce has all property before it and probably would not feel bound to award that item to its owner and simply deal with the rest.
