Members:

Spouse dies without will without assets, and surviving spouse wants to file
lawsuit for Negligence/Wrongful Death.

Do you normally name the Plaintiff as "Administrator" or "Personal
Representative"?

... or first get a court order through the Probate process?  Then file?
