Client owns a residential rental, has management agreement with local real estate broker.  Broker now says that owner/landlord is not privy to the lease of her own property and may not interfere with brokers “tenants”.  Broker has been sued by former tenants, won’t give up deposits and has breached the agreement with owner/landlord.

We want this broker gone and agreement terminated, but she insists the current lease is “hers”.

I can’t quite put my finger on the agency argument here.  Any thoughts would be appreciated.
