I do the same, if the statute says “by mail” then I use Regular First Class.  I only do certified, if the statute specifically says certified.

 

If you like the extra assurance of having the seal from the post office that confirms that you actually did mail it, then you can get a “Certificate of Mailing” (PS Form 3817) for an extra $1.30.  It’s a plain white form that the post office runs through the validation machine and/or “round date” and gives back to you.  No fuss, no muss, nothing attached to the envelope, no hurdles for delivery, and proof of sending in your pocket.

I’ve scanned and converted the Certificate of Mailing form into an editable Word document.  So when I send out a bunch of notices, I put them all on a regular letter sized sheet, 3 per page, pre-filled and the post office puts the stickers next to each addressee.  Then I just attach the sheets with the stickers as an exhibit to my declaration of mailing, very efficient.

I always send “first class postage prepaid”. No reason to send certified.

I would appreciate any collective knowledge on my next step.  I closed a probate and sent certified mail notice to the beneficiary of the closing to start the 30 day objection clock.  However, the beneficiary did not sign for the letter and it was returned.

 

#1 - is certification over-kill so just resend regular first-class?

#2 - if certified is the better method, do I need to hire someone to personally serve now that it was not picked up?

 

Other thoughts on what is normal practice when sending notice would be appreciated.
