[WSBAPT] Funding of CST with a settlement

Facts:  Husband is receiving a settlement for the death of his wife.  When
wife died seven years ago, husband signed a blanket disclaimer of his wife's
estate, which went to a credit shelter trust.  There is no allocation of the
settlement amount in the settlement agreement, just a number.

 

Question 1:  Can part of the settlement now be placed into the disclaimer
trust?  

 

Question 2:  Who owns the  personal injury and wrongful death claim?
