Are the witnesses coming also?  Or are they available to re-sign?  If so, I would just have them sign the regular affidavit, amending it so it states that they witnessed it on the date it was signed.

I have a client coming in one hour. She has a Will that was signed by two witnesses but the notary forgot to stamp it. The "penalty of perjury" language is not there. She does not want to redo the Will but she does know the witnesses- they are close friends she sees often.



I have never had to prove a Will- every probate I have done has had adequate witness affidavits one way or the other. Does anyone have the affidavit that witnesses sign after the fact to prove a Will? Can you email it to me?
