I recently had a similar issue and could not find an alternative, so we ended up filing probate solely for the purpose of allowing the surviving spouse to address the deceased spouse's Medicare benefits.

Client's wife passed away in 2014.  Client is left with over $30,000 in medical bills.  We are trying to assist him in getting financial assistance in paying those.  One big question is what Medicare coverage the wife had (Part A,B,C,D, etc.).  According to Medicare, even the deceased spouse cannot get coverage information without Letters Testamentary or the equivalent.  Has anyone found a workaround to find out Medicare coverage information after the patient is deceased without LOT?  There is no estate to probate, therefore no LOT.
