This is an excellent point. I represent associations. The current state of
the statutes, especially for HOAs, not condos, and the way our appellate
courts interpret them and prior cases, it is comically easy to play "gotcha"
with associations. Very few are able to follow all the rules, and the
current uncertainty about how to vote on assessments, with the surprising
result in the Sudden Valley case (against all expectations; when I litigated
that issue, I talked to the prime legislative sponsor and the attorney
drafter, and I don't think they would agree with Division 1); any member
with enough cash to hire a reasonably adept lawyer can make the whole
association miserable and feed his or her ego endlessly. 

 

The challenge is to find a member with an objection, and a lawyer, who are
willing to find a constructive solution instead of burning down the village
to save it; and to find a Board with a lawyer who can tell them forcefully
that collaborative problem solving is better than trying to build from the
ashes. That's spelled "mediation," if they can't do it on their own. This
takes creative and courageous lawyering on both sides.

You pose a good question and Karl has provided the name of a litigator well
versed in this area, as you requested.  But query whether attorney Kevin
Britt is in the business of representing clients against condo associations
or whether he represents almost exclusively condo associations against
individual condo owners, as his website suggests?
 
 
 
If Kevin Britt does not,  have you received names of litigators who do
