[WSBAPT] Convicted felon and inheritance

Son is convicted felon, served 20 years and now is out. Unknown if restitution was requirement of sentencing. What is possibility of state claiming a portion of the son's expected estate for his confinement costs etc. and for payment of restitution.   Money is to be put in SNT and now son is out, is it advisible to create the trust when parent passes or  pay directly to heir?  Or is there a better way to do it?
