Yes, under 11.96A, all parties (specifically includes heirs) have a right to judicial proceedings for a declaration of rights. This includes any matter defined in 96A.030.

Additionally, if the trust were being administered here, the Trustee would have notice requirements spelled out in 11.98.072.

Sorry for the short answer, but that should get you started.

Good morning-

I am working with a client whose father died recently in another state (his widow is still living).  The father had a pour over will leaving everything to a family trust administered by one of his adult children.  My client would like to see the trust and his brother is not coöperating.  Under Washington law, wouldn't he be entitled to see the trust?  If so, what statute?  I know the laws may be different where they are, but it might help persuade him.
