[WSBAPT] Pot Special Needs Trust

Dear Colleagues:

 

My client has two disabled children who are 64 and 65 years of age.  One
lives in Washington and the other in Oregon.  Both are single, live
independently, and have the same general health status.  The child in Oregon
has an adult daughter; the child in Washington has no children.

 

My client has asked me about a single testamentary special needs trust,
rather than two trusts.  She understands that a child with more need may
receive a much greater percentage of the trust assets, but feels strongly
that whoever needs the assets should have priority.

 

I would appreciate your comments on the possibility of a pot Special Needs
Trust, which I understand is uncommon, and the pros and cons.  Please feel
free to call me if that is easier.
