Anyone else  see this new unpublished case out of division 1?

No probate because no assets (possibly all in trust) Seven years later
action brought for Tortuous interference with inheritance. Not recognized
in WA. Did not meet requirements anyway. Dismissed on Summary Judgment,
but no fees because it raised a “novel or unique” issue.

 

My question is why this is unpublished, thus ensuring that the next case
will also be “novel or unique”. Shouldn’t any case that brings to the
court novel or unique issues be published?
