Hi Felicia,

 

I wouldn’t republish in County B because you were never required to
publish there.  I would file an Amended Notice to Creditors with the May
27th date and publish in County A.  If you received an email confirmation
a couple of weeks ago from the newspaper in County A, I would also contact
the supervisor in charge of their legal classifieds and let them know of
their error.

Colleagues,

 

Decedent lived and died in county A.  Estate was opened in county B.
Notice to Creditors was emailed to papers in both counties, with date of
first publication shown as April 30, 2014.  I just discovered that
although Notice was properly published in county B, the newspaper in
county A never published the Notice, though they did get the email.  The
soonest they can publish now is May 27.

 

1.  Must I file and amended Notice to Creditors with the court, showing
the new publication date as May 27?

 

2.  Must I republish the Notice in county A, showing the the new
publication date as May 27?
